TERMS AND CONDITIONS – EXECUTIVE HOSPITALITY MASTERMIND™

These terms exist to protect the integrity of the circle, the confidentiality of your experiences and the emotional safety of the group. They support the quality of the space we create together.
These Terms and Conditions apply to the Executive Hospitality Mastermind™ organised by Hospitality Leaders Club™, operated by Between Forks e.U.
By joining the Mastermind™, you confirm that you have read, understood and agree to all terms below.
1. Nature of the Mastermind
The Executive Hospitality Mastermind is a peer to peer leadership circle for senior hospitality professionals. It provides a space for reflection, strategic clarity, accountability and collective wisdom.
It is not:
• Therapy
• Counselling
• Coaching
• Psychological treatment
• Crisis support
• Mental health care
Participants are fully responsible for their own personal and emotional wellbeing.
2. Confidentiality (Core Rule, Never, Nothing, No One)
Confidentiality is the foundation of the Executive Hospitality Mastermind. Participants agree to absolute confidentiality regarding:
• The identity of all members
• All personal stories, emotions and challenges shared
• All business, financial or operational details discussed
• All reflections, conflicts, insights and vulnerabilities expressed
• All written, visual or digital content including chat messages
• Any data, materials or documents shared in the group
Strictly prohibited:
• Audio or video recording
• Screenshots of any kind
• Photography of participants or screens
• Sharing or forwarding chat messages
• Discussing session content with colleagues, family or third parties
• Using AI tools to transcribe, summarise, analyse or store content
• Sharing any element of the Mastermind beyond the group
• Reproducing group processes, phrases or frameworks publicly
Any breach of confidentiality results in immediate and permanent removal without refund.
Confidentiality remains binding indefinitely, even after leaving the Mastermind.

3. Behaviour, Respect and Group Safety
Participants must:
• Treat one another with respect and professionalism
• Listen without judgement
• Share honestly and from experience
• Avoid interrupting or dominating the space
• Avoid discriminatory, aggressive, manipulative or shaming behaviour
• Respect emotional boundaries and group safety
• Follow the structure and timing set by the Facilitator
The Facilitator may interrupt, redirect or stop any intervention to protect the group.
Hospitality Leaders Club may remove any participant whose behaviour:
• Repeatedly disrupts the group
• Endangers the emotional or psychological safety of others
• Violates boundaries, confidentiality or structure
Removal is final and non refundable.
4. Role and Authority of the Facilitator
The Facilitator is responsible for holding the structure, emotional safety and strategic intention of the Executive Hospitality Mastermind. Participants agree to follow all instructions provided by the Facilitator during sessions.
The Facilitator has the authority to:
• Guide and adjust the flow of each session
• Maintain timing and presence
• Interrupt or redirect contributions when necessary
• Stop behaviours that compromise clarity or safety
• Invite silence or reflection
• Mediate tensions within the group
• Determine when a topic is complete
• Uphold confidentiality and protect the integrity of the space
The Facilitator’s process decisions are final during each session.
5. Boundaries of the Facilitator Role
The Facilitator does not provide therapy, crisis intervention, counselling, business consulting, performance evaluation or personalised emotional processing.
The Facilitator does not replace professional support systems. Participants agree not to impose expectations beyond the defined scope of Mastermind facilitation.
6. Facilitator Well-being and Safety
Participants agree to:
• Treat the Facilitator with professionalism and respect
• Avoid emotional offloading outside the session
• Refrain from demanding guidance beyond the structure
• Communicate respectfully and through appropriate channels
Behaviour undermining the Facilitator’s authority or wellbeing may result in removal without refund.
7. Session Note Taking and Data Handling by the Facilitator
To maintain continuity and coherence, the Facilitator takes handwritten notes during sessions. These notes support:
• Identifying topics for future sessions
• Capturing challenges raised by participants
• Tracking accountability commitments
• Preparing session summaries for the next meeting
Notes are always handwritten using pen and paper to avoid digital storage and cybersecurity risks.
Notes are used exclusively to facilitate the Mastermind experience and are never shared with participants, employers or third parties.
At the beginning of the following session, once the summary and accountability review have taken place, all handwritten notes from the previous session are permanently destroyed.
Participants accept this process as part of the Mastermind’s confidentiality and safety standards.
8. No Trial Sessions or Observers
To protect confidentiality and emotional safety, no trial participation, guest attendance or observers are permitted.
Every person in the room must be a confirmed participant who has accepted these Terms and Conditions.
9. Mastermind Structure and Format
The Mastermind follows a clear, structured format explained at the start of the programme.
Sessions may include:
• Opening check in
• One or more Hot Seats
• Group reflection
• Experience based insights
• Clear commitments for the next period
Hot Seat definition
A Hot Seat is a structured moment where one member shares a challenge or goal. The group responds from personal experience, not advice.
Participants agree to respect the structure, timing, process and the Facilitator’s guidance.
10. Not a Therapy or Mental Health Service
The Mastermind is a professional environment. It does not replace therapy, counselling, psychological or psychiatric treatment or crisis support.
No one in the group diagnoses, treats, fixes or provides mental health services.
If a participant needs clinical support, they must seek professional help independently.
11. Commitment, Duration and Refund Policy
The Executive Hospitality Mastermind™ is a one-year programme.
By joining the Mastermind, participants commit to a full twelve-month participation period. Payment may be made annually or through a monthly payment plan. A monthly payment plan is a payment facility only and does not constitute a monthly, flexible or cancellable subscription.
The programme year begins with the first official Mastermind session, not with the payment date.
11.1 Initial Alignment Period
The Executive Hospitality Mastermind™ includes an Initial Alignment Period designed to ensure mutual fit, clarity and responsible commitment.
This Initial Alignment Period consists of the Participant’s full and consecutive attendance at the first three official Mastermind sessions. The onboarding or welcome session does not count as part of these three sessions.
If, after attending these three consecutive Mastermind sessions with genuine engagement and active participation, the Participant determines that the Mastermind is not the right fit for them, they may choose to conclude their participation at that point.
11.2 Refund conditions during the Initial Alignment Period
In such case:
• If the Participant has paid annually, Hospitality Leaders Club™ will refund 50% of the net programme fee paid, excluding VAT. A fixed administrative cancellation fee of €200 applies.
• If the Participant is on a monthly payment plan, participation will be concluded immediately and all future payments will be cancelled. A fixed administrative cancellation fee of €200 applies.
11.3 After the Initial Alignment Period
Once the Initial Alignment Period has concluded, participation becomes fully binding for the remainder of the one-year programme.
After this point, no refunds, partial refunds, early cancellations, payment suspensions, pauses or credits apply under any circumstances, including but not limited to changes in personal, professional or health situations, scheduling conflicts or dissatisfaction with the experience.
11.4 Precedence of contractual documents
Participation in the Executive Hospitality Mastermind™ is governed by the Executive Hospitality Mastermind™ Participation Agreement, which is provided and accepted prior to payment.
In case of discrepancy or interpretation differences, the terms set out in the Participation Agreement shall prevail over these Terms and Conditions.
12. Punctuality and Attendance
Sessions begin at the scheduled time.
• Maximum delay is ten minutes
• Entry after ten minutes is not allowed
• Late arrivals count as absences
• Absences are not refunded or credited
• Sessions are not recorded
13. No Transfer or Substitution
Membership is strictly personal. It cannot be transferred, shared or reassigned. Corporate billing is allowed, but the named participant remains fixed.
14. Group Composition
To protect neutrality and freedom of expression, groups may not include:
• Business partners
• Romantic partners
• Spouses
• Close friends
• Family members
• Direct colleagues in the same hotel or department
If a relational conflict is identified, the organiser may reassign a participant.
15. Group Admission and Allocation
Between Forks e U curates groups based on leadership level, background, personality, confidentiality needs, availability, group fit and value exchange.
Admission is selective and not automatic.
If a participant’s schedule does not align with their chosen group, the organiser may allocate them to another cohort.
16. Admission Process Clarification
Admission is discretionary. Applications and invitations are assessed individually.
The organiser is not required to justify acceptance or non acceptance.
17. Group Size
Groups are intentionally small. The organiser typically selects between six and eight leaders.
This range is indicative rather than contractual.
18. Limited Number of Mastermind Groups Per Year
To preserve the highest quality of facilitation, depth and continuity, only a limited number of Mastermind groups are opened each year.
Participants acknowledge that:
• Only a limited number of circles are curated annually
• New groups are formed only when capacity and alignment allow
• The organiser is not obliged to open additional groups
• Admission may be delayed if all groups are at full capacity
This limitation protects the emotional integrity and personalised nature of the Mastermind.
19. Mastermind Scheduling
The organiser establishes the initial session date and time for the group. Once the group is formed, all members agree that the Mastermind will follow a consistent schedule based on that original structure.
Sessions will therefore take place:
• Always on the same weekday as the initial session
• Always at the same time as the initial session
• Always following the same monthly rhythm, for example the last Tuesday of each month at 16:30
The group may bring a session forward by up to one week when necessary, yet the weekday and time remain fixed without exception.
Participants acknowledge that the organiser does not offer individual scheduling preferences and that the coherence of the Mastermind depends on a stable, predictable rhythm agreed collectively at the outset.
20. Data Protection and Privacy
Hospitality Leaders Club protects all participant information under Austrian and EU law including GDPR.
Strictly prohibited:
• Sharing the Mastermind member list
• Selling or distributing participant data
• Adding participants to unrelated mailing lists
• Using personal information outside the Mastermind context
Corporate sponsors receive no access to session content.
21. Removal From the Mastermind
A participant may be removed without refund for:
• Breaching confidentiality
• Disrespectful or aggressive behaviour
• Manipulation or toxicity
• Repeated disruption
• Failure to pay
• Misuse of data
• Violating the format or boundaries
Removal is definitive.
22. Rescheduling and Changes by the Organiser
The organiser may reschedule a session, change the Facilitator or adjust the format.
Rescheduling does not entitle participants to refunds or credits.
23. Facilitator Change or Substitution
The organiser may assign a new Facilitator when required.
A change in Facilitator is not grounds for complaint, refund or compensation.
24. Intellectual Property
All materials, frameworks, tools and processes are the exclusive intellectual property of Hospitality Leaders Club and Between Forks e. U.
Participants may not:
• Copy
• Teach
• Publish
• Modify
• Reproduce
• Sell
• Share
Any part of the content or methodology.
25. Photography and Screenshots
Screenshots, photos and recordings are not allowed.
If a group photo is taken by agreement, it must remain private.
26. Liability
The organiser is not responsible for:
• Emotional reactions
• Business or personal decisions
• Technical issues
• Outcomes of participation
Liability is limited to the membership fee.
27. External Groups
Participants may create their own communication groups outside official platforms.
The organiser does not supervise or take responsibility for these.
Participation is voluntary and at the participants’ own risk.
28. No Sales, No Pitching, No Lead Generation
The Mastermind is not a sales environment. Members must not:
• Sell or promote services
• Pitch offers or programmes
• Collect data for commercial purposes
• Add members to mailing lists without consent
• Use the Mastermind to generate clients
• Turn conversations into sales opportunities
• Recruit members into other masterminds
Violation of this rule may result in immediate removal without refund.
29. Protection Against Unreasonable Claims
Participants accept that:
• The process is subjective
• Vulnerability and challenge are part of the journey
• Discomfort is not grounds for complaint
• Disagreements do not entitle refunds
• Dissatisfaction with content or facilitation is not a valid reason for refund
The Mastermind remains non refundable in all ordinary situations.
30. Governing Law
These Terms are governed by Austrian law.
Disputes fall under the jurisdiction of the courts of Vienna.
